GENERAL CONDITIONS OF SALE

1. Acceptance of the general conditions of sale and conclusion of the contract

1.1 The contract stipulated between Ada Sorrentino srl (hereinafter " Ada Sorrentino ") and the Customer (i.e. the individual, natural person, who makes the purchase on the Site, not relating to his commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even if only partial, of the order by Ada Sorrentino. In the event of non-acceptance of the order, Ada Sorrentino will in any case promptly notify the Customer.

1.2 By placing an order in the various ways provided, according to the order form on the Site (hereinafter the "Order"), the Customer declares to have read all the information provided to him during the purchase procedure and to accept these general conditions in full (hereinafter the "Conditions").

1.3 These Conditions may be printed or saved on a durable medium, in compliance with the provisions of the art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

2. Purchase method

2.1 The products offered for sale by Ada Sorrentino are solely those present on the Ada Sorrentino website at the time the Order is placed, as described in the relevant information sheets.

2.2 In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but may differ, for example. by color and size (also based on the browser and monitor used to access the Site and view the images).

2.3 To place an Order, the Customer must complete the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and/or products he intends to purchase. The Customer must also request Ada Sorrentino , if desired, to issue a tax invoice relating to the purchase, pursuant to art. 22 Presidential Decree no. 633/1972.

2.4 The correct receipt of the Order is confirmed by Ada Sorrentino by means of a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will summarize the purchase conditions, as required by applicable law, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and possibly communicate the necessary corrections of incorrect data without delay.

3. Prices and Payment Methods

3.1 The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions.

3.2 The following payment methods are available:

(i) PayPal
For payment, the customer can use the Paypal circuit according to its specific methods.
(ii) Credit card
In cases of purchase of goods with credit card payment method, the transaction can take place through the secure Paypal server or another secure server chosen by Ada Sorrentino
In no case and at no stage of the payment will Ada Sorrentino be able to know the information relating to the Customer's credit card, transmitted via a protected connection directly to the website of the banking institution that manages the transaction. No Ada Sorrentino computer archive will retain such data and therefore in no case can Ada Sorrentino be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment.
(iii) Bank transfer
In case of purchase by bank transfer, the bank details for payment will be displayed. The goods will be shipped only upon actual receipt of payment in the bank.
(iiii) Cash on delivery (only for Italy)
In case of cash on delivery, payment must be made exclusively with cash upon delivery of the purchased products. Cash on delivery entails an additional cost of Euro 5 to be paid by the Customer for collection costs. Cash on delivery can only be made for purchases of amounts lower than Euro 999.99

4. Delivery of products and related costs

4.1 The purchased products will be delivered to the address indicated by the Customer in the Order within 24-48 hours of acceptance of the Order by Ada Sorrentino , at the cost specifically indicated on the Site before sending the Order. Ada Sorrentino reserves the right to accept or not accept deliveries requested outside Italian or European borders. In any case, for deliveries to be carried out outside Italian borders, shipping costs and delivery times may vary.

4.2 With regards to deliveries requested in countries not belonging to the European Union, any import customs costs will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of their country in advance to verify the costs and any import limits.

4.3 The delivery times indicated by Ada Sorrentino must be considered purely indicative and a delay compared to them, or any delivery made with subsequent split shipments does not entitle the Customer to refuse the delivery itself and to request compensation or compensation.

4.4 Upon delivery of the products, the Customer is required to check:
that the number of packages delivered corresponds to what is indicated in the transport document, that the packaging is intact, not damaged, wet or otherwise altered, even in the closing materials (adhesive tape or metal straps).

Any damage to the packaging and/or to the product or the mismatch in the number of packages or indications must be immediately detected by placing a specific indication on the delivery document of the product to be returned to the courier.
Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the methods set out in this document.

5. Right of withdrawal

5.1 Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

5.2 To exercise the right of withdrawal referred to in the previous article 5.1, the Customer must send Ada Sorrentino a communication to this effect, within the terms indicated, to the following email address info@sorrentinoada.com, or use the appropriate form on the Site .

Registered users will be able to access the "RETURNS" section of their user dashboard and manage return requests.

5.3 In the event of withdrawal, the Customer may return the products to Ada Sorrentino at his own expense within 14 (fourteen) days of the withdrawal itself, to the following address Ada Sorrentino Via Leonardo Murialdo 38 , 80047 San Giuseppe Vesuviano (NA). The goods must be returned intact, complete with all their parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without are signs of wear or dirt, in compliance with the following conditions:

The right of withdrawal cannot be applied to products for which the customer has requested customisation.

the right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the product purchased (e.g. accessories, complements, etc...);
for withdrawal to be possible, the product must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, tags, seals, etc...);

in the event of damage to the goods during transport, Ada Sorrentino will notify the Customer, to allow him to promptly file a complaint against the courier chosen by him and obtain the relevant reimbursement; the product will then be made available to the Customer, simultaneously canceling the withdrawal request;
Ada Sorrentino will not be liable in any way for damage, theft or loss occurring during or in any case in connection with the return shipment.

5.4 Ada Sorrentino will refund the Customer the entire amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of the Legislative Decree. 21/14), within 14 (fourteen) days of withdrawal, through a cancellation procedure of the debited amount, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not bear any costs as a consequence of said reimbursement. Ada Sorrentino may suspend the refund until receipt of the returned product or until the Customer demonstrates that he has correctly sent the product back, whichever is earlier.

5.5 In any case, the Customer will lose the right of withdrawal in cases where Ada Sorrentino ascertains that:
the returned product and/or its accessories, and/or its packaging are not intact;
the product is missing its external packaging and/or the original internal packaging;
the product is missing integral elements and/or accessories (e.g. closures, laces, buckles, etc.).
In the event of forfeiture of the right of withdrawal, Ada Sorrentino will return the purchased product to the sender, charging the shipping costs and, if already refunded, the price of the product.

6. Guarantees

6.1 All products sold by Ada Sorrentino are covered by a 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of the Legislative Decree. 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or the payment receipt, together with the transport document.

6.2 The warranty for defects of conformity will apply provided that the relevant product has been used correctly, in compliance with its intended use and as provided in the use and washing instructions present in and/or with the product.

6.3 In the event that, for any reason, Ada Sorrentino is unable to return a product under warranty to the Customer (restored or replaced), or if the repair or replacement is excessively expensive, also due to the value of the product, Ada Sorrentino will be able to proceed with the appropriate reduction of the price paid, i.e. the refund of the entire amount paid with termination of the contract.

6.4 In cases where the application of the guarantees requires the return of the product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

7. Complaints and request for information

8. Privacy

8.1 The personal data collected when placing the Order will be processed by Ada Sorrentino for the sole purpose of satisfying the express requests of the Customer, in compliance with European Regulation 679/2016 and the privacy information on the site. Any further processing will be carried out only with the express consent of the Customer.

9. Applicable law

9.1 The sales contract referred to in these Conditions and its execution is governed by Italian law, with the non-application of conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the municipality of residence of the Customer will be competent to resolve the related disputes.
